These published decisions are selected from numerous proceedings in which I have successfully represented my clients before the civil panels of the Federal Supreme Court in recent years.
Judgement of April 23, 2021- V ZR 248/19
The Federal Supreme Court upholds the Federal Privatization Agency’s rules for the privatization of former state-owned land in eastern Germany. On my appeal, an unfavorable judgement by the court of appeals is overturned.
Judgement of March 16, 2021 – X ZR 149/18
In this patent invalidity case, the Federal Supreme Court decides in favor of the plaintiffs that I have represented. This case is part of a large series of cases between telecommunication providers and manufacturers of smartphones represented by me sued by a non-practicing patent holder. This complex of cases ends with a complete success for my clients.
Judgement of February 2, 2021 – X ZR 170/18
The Federal Supreme Court corrects the claim construction of the court of appeals and finds in favor of my clients, the patent owners and plaintiffs.
Judgement of January 26, 2021 – XIII ZR 17/19
The Supreme Court confirms that my client, the operator of the electrical grid, does not have to indemnify operators of power plants for interruptions caused by construction activities.
Judgment of January 26, 2021 – II ZR 391/18
In this leading case on the subject of actions to nullify shareholder resolutions, the Supreme Court finds that a former shareholder no longer has standing to sue and decides in favor of the company that I represented.
Judgement of January 14, 2021 – I ZR 40/20
The Federal Supreme Court changes its jurisprudence concerning the burden of proof in trademark cancelation actions and confirms the position of my client, the cancelation plaintiff.
Judgment of November 25, 2020 – VIII ZR 252/18
The Federal Supreme Court clarifies important questions in the field of automotive leasing, in particular concerning the relationship of claims by the lessor and the lessee against the seller.
Judgement of October 15, 2020 – I ZR 210/18
The Supreme Court decides in favor of the internet marketplace represented by me that the protection of trademark rights does not extend to the identity of the seller.
Judgement of September 23, 2020 – KZR 4/19
This case forms part of a long line of antitrust damage claims where I have represented the defendants.
